I can't take it! I just checked the small claims court online for my case summary and I found, "03/17/2009 NOTICE OF APPEAL FILED BY (HUBBS, LYNDA) . RECEIPT # LAV539201009 . AT THE WINDOW"
Filing an appeal in bad faith means that: (1) you filed your appeal without strong support for your position, (2) you intended to harass or delay the other party, and/or (3) you filed your appeal to encourage the other party to abandon the case.
That is encouraging, Linnette, let's hope the court sees it that way.

I wonder if she could be bluffing and is really prepared to go with it herself, thinking this may intimidate Tavia enough to get her to throw in the towel.
We must believe in justice. Did the landlord base her appeal on a court error? Have the laws changed? I recall a case or two in which the appellant had to put up the money owed to the prevailing plaintiff before it could be appealled. This may be a chance to get your other $500 back. Another idea is to go to a Court TV and sue her for $5,000 for intimidation. Judge Judy would have fun with this. People's Court will fly both of you to New York, but not together! Regardless, don't admit one dime of "damage" in your brief.
